Loren K. Messerly

Law Practice

Mr. Messerly litigates for a variety of clients -- developers, insurers, lenders, entrepreneurs, small business owners, individuals – and in a variety of legal practice areas – real estate, construction, contract, insurance coverage, personal injury, medical and legal malpractice, creditor rights, bankruptcy, and transportation. Some recent successes include summary judgment dismissal of a non-compete enforcement lawsuit, judgment for $100,000 in attorney fees, and summary judgment dismissal of a medical malpractice lawsuit against a local chiropractor.

Prior to joining the firm, Mr. Messerly gained trial and courtroom experience through a stint as an Ada County deputy prosecutor handling various misdemeanor prosecutions. He also developed his civil litigation practice in the creditor rights and bankruptcy practice group of the leading law firms in the state of Idaho, where he represented a wide range of lenders, traditional and non-traditional, in litigation in federal and state courts. He spoke at several forums regarding both bankruptcy and creditor representation. Mr. Messerly also gained a strong understanding of judicial strategy through his three years working for judges, both in federal and state court. He worked one year for a trial judge in Utah handling a civil and domestic litigation calendar and then he worked two years for a federal bankruptcy judge in Ohio. Through all of this wide range of experience, Mr. Messerly has earned a reputation as a skillful and persuasive writer and litigator who can be trusted by judges, the bar, and clients alike.

With a strong interest in fulfilling his civic duties, Mr. Messerly seeks opportunities to provide legal advice and representation to those most in need. To that end, he is a volunteer with the Women’s and Children’s Alliance, with Law Day, and with the Idaho Volunteer Lawyers Program. He is also active with the Idaho State Bar as a member of the Bankruptcy Law Section, for which he has written several articles.

Mr. Messerly has presented and/or prepared materials for several bankruptcy-related seminars and CLEs. He has authored three articles published in the newsletter for the Commercial Law and Bankruptcy Section of the Idaho State Bar: The Automatic Stay Starter Interrupters, a Tale of Technology Adapting to Bankruptcy; Has Travelers Ended the Controversy About Unsecured Claims That Seek Postpetition Attorney Fees? and Does Idaho Law Protect the Unwise or Foolish Business Borrower Against “Unfair” Default Interest and/or Late Fees?
